QUESTIONS ABOUT THE CASE

WHY DOES DUSTIN STILL NEED EXONERATION?

Release on parole did not erase Dustin’s convictions. He remains convicted of murder and must register as a sex offender because of the abduction conviction.

WHAT DID THE 2008 HEARING ESTABLISH?

The circuit court found Brown credible when he testified that he acted alone and that Turner did not murder or restrain Jennifer Evans, and she was already dead when they drove away.

WHY WERE THE CONVICTIONS LEFT IN PLACE?

Later appellate courts ruled that Turner had not met Virginia’s demanding standard for a writ of actual innocence: The convictions therefore remained in place.

WHY MUST TURNER REGISTER AS A SEX OFFENDER?

Virginia classifies his abduction conviction as a registerable sex offense. Although the 2008 court found no abduction, the conviction – and the registration requirement – remain.

WHAT WOULD COMPLETE EXONERATION MEAN?

Complete exoneration would overturn Turner’s remaining convictions, clear his name, and end the sex-offender registration requirement.
